Need some info on status of holidays not taken from work through illness.At the beginning of December 05 i had to start my time off work due to a shoulder problem,and after having an operation on it i am still unable to return to work.Ive been told my five days plus three statutary days at Christmas would be carried over untill i returned,but as the companies financial year starts in April will i have to forfit these days or will they have to still give them to me,or could i ask to have my holiday paid to me now while im still claiming statutory sick pay.I can not throw off the sick to take the 8 days as i would then lose my mortgage protection payments and would have to stand another 30 days before being able to start claiming it again,so any help welcome.Thanks.

I doubt you could claim holiday pay while you're off sick. The holiday entitlement would, I suspect, largely depend on your company's policy on holidays. I doubt they have any legal obligation to carry over your holiday into the next financial year.

Depends on your company's leave policy. Companies don't have to let you carry holiday over but many do (albeit often with a time limit of when to use the carried-over days). You'll need to check with your company. Even if they don't have such a policy or the time-limit is too short, there's no harm in asking nicely if they can make an exception.

If you are not successful at carrying over the leave you should still be entitled to full pay for the leave days. From the CAB:

If you become ill while on holiday and your employment contract does not allow you to take time off at a later date, you should get a mixture of SSP and holiday pay to make up your wages to your normal amount of pay.
