There's no reason for it automatically to become permanent unless there is something in the agreement between the agency and the company where you work.

However, there's been a number of Tribunal cases where the company has had to take on the responsibilities of employer (to pay redundancy etc) because of the way the agreement has been set up.

Many thanks for your reply
Cas is correct, but not for the reason given. Its not that the contracts were set up in a particular way - its that after a time an employee gains legal protection from unfair dismissal - irrespective of whether the original contract was temporary or permanent.

Okay let me explain further, a friend has been employed in a private school for over two years full time, should they not make her post permanet? I thought after 2yrs they would have to make it that?
Thanks again
I too work as a temp in Local Governament and have done for over two years. There is a restructure going on and as yet i am in limbo as to whether i will be told im surplus to requirements or whether i'll get a permanent contract (despite the fact they know id like to stay). I have looked into whether i have rights, but it seems that as a temp (regardless of how long ive been here) my rights arent the same as those of a perm member of staff. However, i am able to join the union. But im afraid theres no guarnatee that a temp job will be made perm.
