Give the boss a ride or not ?
i have resigned from my post last friday following a grievance procedure made against my boss for bullying/harrassing me. Everything was denied by the management of course and instead they decided that sacking me would be suitable because i think i was trempling on their feets and possible a trouble maker?
I have done no wrong in my job,never being sick,always polite, bringing the money.
I wish to have the last words by means of taking my case to court should i leave them sacking me or resign.
my letter of resignation is not made yet.

The reason you have posted is not a good enough one. Check your contract and terms of employment for the finer details. If they want rid of you, can't sack you for gross misconduct, and there is no other get-out in their terms, I would advise waiting for them to make you an offer to leave. This happened to my husband recently, and although he would happily have told them to stuff it, he didn't, and they had to come up with a decent payment package including money in lieu of notice and all holiday owed. He was being bullied too, they all denied it too, but if you resign, you're doing them a huge favour and saving them money. Sit tight, keep doing your job professionally and wait for them to come up with the goods. Oh, and remember that if they try to persuade you, insist they include a good reference in the 'leaving' package!! That way they can't scupper your chances in the future.

you can make a case for constructive dismissal if you do resign but its much much easier to make a case for wrongful dismissal - plus if the worst does come to the worst new job wise it is easier to claim benefits if you have been sacked rather than resigned so i would advice waiting for them to do it for you... much easier in the long run.

It is not possible to sack someone who is in the process o making a grievance claim! apart from anything else it is opening the firm up to prolonged and expensive legal action! Did they go though the correct disciplnary procedure by an initial investigative interview informally and then a formal disciplinary meting with whitnesses and written advance notice of the meeting to you?

Have you appealed against there decision ? if not appeal.
Make sure you keep a note of everything regarding your problems at work.
I would try and go on the sick for a while before you jump to a desion. Your doc should understand you are under a lot of stress and give you a sick note for a week or so.
Right check your house hold insurance either the contents or the building one if they are separate.
Most if not all will have employment cover and they will advise and pay if you have to take the employer to a tribunal. They will only pay if your case is 51% chance of winning.
It can be very stressful along the way as your company has denied what has gone on already. Except them to make allsorts of things up about you don't worry. They will do this to scare you from going to a tribunal.
Most companies don't want to go to a tribunal and will wait right to the last minute even on the day of the case to settle.
If you feel you have a case and you get advice saying you will not win your case. Still go it alone for the time being and fill your own tribunal form in which you can do online.
They will say Yes or NO if they think you have a case or not.
There is a dead line of 3 months from you resigning then extended to 6 months.

did get on very wellwith boss/sharing ideas/out for drinks.
we were little bit too close if you see where i am going. i decided to stop and avoid his demand. march, i received a call from him stating that someone made a official complaint against me and the area manager knew about but not to worry because he knew i was a good worker ready for promotion. I would not settle for it and made a grievance procedure against that person and because of his lack of seriousness.the procedure was undelt until 1 month ago. work atmosphere started to be tense and a lot of mistakes were made, tills not done properly, never reumboursed for the money i advanced him, he started to swear a lot and throwing paperwork at me or clothings behind others members of staff. i though that he was tired because he was doing the work of others managers so i worked every days off, sundays,stayed late to help out.
waist of time cos he started to threat me with suspension cos " i am not listening,i have a attitude" . I asked for a meeting to talk about it because i was left confused cos every one knows me for doing my job.
No concrete response came from him with an another witness present at the time. Was suspended after repetitive threats same reason.My first grievance was delt with but made another one against my boss from bullying.
Lost 2 battles. they founds me guilty on severals counts.

I was told that i was dismismed but very quickly i have opted for a verbal resignation .
I have had a rethink and has not sent my letter yet.
i did not think when i typed "give the boss..."
Because nothing has been answered to me or solved!
i wish to see him admitting to his bullying /harrassment.
