Is it illegal to advertise a job which the employer has no intention of interviewing for?

Could someone please clarify for me. If an employer has a vacancy, but they already have someone they are going to give the job to, I know that they sometimes place a very samll advert in a paper (any paper - ie - not local!) so that they get very few enquiries. Is this legal?

Also, if they DO receive enquiries from extremely qualified people, who are certainly able to fill the requirements, do they have a legal requirement to interview?

My husband applied, and was told that they were were interested and would follow up the following week. they didn't. Now, whenever he calls (and he has also emailed to ask for an update), he is told "she's not in", or "she's stuck in traffic", or "she's upstairs"(!?)

Maybe your husband wasn't suitable for the position and that's why he hasn't been selected for interview?


It is certainly legal to advertise with a minute advert in some obscure newspaper, in fact the employer is under no legal obligation to advertise the position at all, they could just give it to whoever they wanted with no interview or anything.

I'm pretty certain they have no legal obligation to interview once applications have been received either.

Thanks Cheekychops. My husband is certainly qualified to do the position (standing on his head if they required), and they did say they would contact him. perhaps they are just disorganised. Thanks
Public organisations such as local councils and education depts have quite strict regulations about how jobs are advertised, but beyond that it's up to the boss how and when a job is offered / advertised. Sounds like your man isn't wanted - I'd move on and forget it in your position.
The company don't have a requirement to do anything.

They could advertise a hundred jobs it doesn't mean to say they have to interview.

From personal experience would you want to work for a company like this?

Your husband could ask if the position has been filled. If it has he could ask why he wasn't interviewed. Sometimes companies advertise then freeze the recruitment for a variety of reasons. It's a reasonable question and would show that he was interested
