In brief...I had swine flue and was signed off by the doctor for a week. My boss sent me home and told me to return when better, However I get back to work and they inform me they are not paying me...am taking formal grievance procedue and that is fine...
However, I called my bank today to check cleard funds and they said my full wages are going in tomorrow! After a little investigating I discover that my stupid company havent inputted details property and have authorised by pay.
Where do i stand? Are they allowed to take it out of my next pay packet? I am continuing my complaint regardless as the way they have treated the entire thing is disgraceful...
Do you normally get sick pay? What does your contract say about it? Do you normally get SSP only?
How far in arrears or advance are you normally paid?
The law states quite clearly that if you are overpaid by your employer by mistake, you must repay it.
yes they can ask for it back It's a bit of an odd arrangement that any period of sickness relies of someone's (more than 1 prson's?) sympathy as to whether you get paid or not. I can't really see you winning a tribunal if the company have rules liek "at a manager's discretion"
i will win it.... There are two of us and everything they have tried to defend themselves with we have had answers for so it will be fine. It is just a hassle. Its the reasoning like "at managers discretion" that will help! That and that they dont state the "justifiable reasons". My manager has agreed to pay me.
But i am not questioning that I am questioning if they can take the money out of my next pay.
