Holiday entitlement on resignation

When resigining what happens with holiday owed? I have 3 and half weeks owed and need to give one month notice. Are my employers obliged to pay me out (less the normal tax) or are they obliged to let me take the hol time? Either way is fine with me but I'd like to know where I stand before handing my resignation letter in.

When you resign and give the right amount of notice (one month in your case, you say), there's nothing the company can do to change that date - if that is your requirement.
Holiday accrued but not taken is then subject to negotiation. They could insist that you take it and leave the job earlier (but be paid to the contract date) or they could pay you the money. To an extent, you can play it to your advantage if you want the money.

To save money (or because of the way budgets work) organisations I have worked with preferred to make you take your remaining holidays during your notice period, but of course if they really need you there and can afford it they will want you to work and pay you for your outstanding holidays afterwards
