Pay spinal point discrepancy

I was offered a position at spinal point 01 as stated both on my offer letter and contract of employment. I am however being paid at spinal point 00 as I signed a start form which indicated this. I realise it's my own fault for not reading the form thoroughly enough but where do I stand now? HR are sticking with spinal point 00 but I feel that as my contract states point 01 then I should be paid this.

My manager agrees with me, she offered me the higher pay due to my qualifications but says her hands are tied by HR.

HR are being very sneaky by the sound of things. Your offer letter and contract of employment clearly state that you will be paid in accordance with scale 001; this is the basis on which you accepted their offer of employment. Your employer is trying to vary your contract unilaterally (i.e. without mutual agreement from you). For an employer to be able to unilaterally vary a contract of employment, the variation must be �reasonable�. Yes you should have read the form before signing it but even if you had noticed the discrepancy, you might have just thought it was a typo and not mentioned it anyway? It should have been brought to your attention that by signing the form, the terms of your contract (i.e. your salary) would be varied (which wouldn�t be reasonable in any event). Your boss should have the power to override HR on an issue like this and she should feel an obligation to as she is the one who offered you the higher salary.
