Car Ownership Dispute...

I am Having a dispute with my mother and father over ownership off a car. They said they gave me a car for my 21st birthday and said they would pay for the 1st year insurence and that they had signed it over to me from then on i have been using the car and been living at a different house. After a dispute they claim that they want the car back as they never given me the v5 i do not know if i am the signed owner and after say that they had signed it over they now are saying that never did so. I would like to know where i would stand in a court? As they say if i do not return the car they will report it as stolen.

Did you fill in/sign any part of the V5 and see that it was sent off to the DVLA ? Have you received the ammended V5 with your name as the owner ?
If not, your parents own the car.

...also, if you have not personally seen that the V5(C) form is registered in your name, you cannot guarantee that you are insured to drive the car.

The V5 has nothing to do with ownership, it merely records the "registered keeper".

If they paid for the car and paid the insurance yo ma have difficulty arguing it's yours.
However is yours the only name on the insurance? If so that may help your case.

Incidentally have you changed address since you took out the insurance?

On option is just to be grateful for everything your parents have done over the years, including providing a car for a year- you could just hand it over, thank them and try to rebuild a relationship, and try to stand on your own two feet going forwards

rojash is quite right whose name is on the V5 has no bearing on the legal owner of the vehicle, but seriously if you've fallen out with your parents to such an extent that they want the car back, just give it to them and get one of your own- you can still pick up runarounds for £250, so just let it go since they paid for it in the first place, but on another note- try to patch things up with them, you'll regret it later if you don't.

Charming? Who needs parents eh? I think that the posts above are correct and that you can not claim to be the rightful owner of this car.

Rojash is correct,V5 only proves the registered keeper not the owner-DVLA so neither of you have title ownership,as to this birthday gift from your parents under common law they have to honour their agreements,in short not lie,but would you really want to get invoved in a court case with your parents.
