How Much Is A 'substantial' Compensation Settlement?

I am currently waiting on a compensation claim and everything regarding liability is all sorted, I am just currently undergoing some treatment before I can go for another report so my solicitor can value the case, and I would really like to have an idea what it is worth, all my solicitor has told me is that it is going to be a 'substantial' amount. anybody have an idea what a solicitor would class as a substantial amount?

unfortunately, no. How long is a piece of string?
It will depend on the nature and impact of your injuries.
If you post some idea of the injury and the length of time it has subsisted, I'll have a look at the JSB Guidelines (or whatever they are called now).

I quite understand if you don't want to post those quite personal details though.

ok, broken nose that required surgery and is still not fixed, loss of smell, whiplash type neck injury, concussion, severe ptsd and severe depression since the incident which was 14 months ago, I have also around £45,000 in loss of earnings since it happened. that is everything I think?

I was assualted at work by another workman.
Loss of smell is normally in the £17k - £23k bracket.

Broken nose:

(c) Fractures of Nose or Nasal Complex
(i) Serious or multiple fractures requiring a number of operations and/or resulting in permanent damage to airways and/or nerves or tear ducts and/or facial deformity. £7,600 to £ 16,500
(ii) Displaced fracture where recovery complete but only after surgery. £2,800 to £3,650

PTSD

(b) Moderately Severe £16,600 to £42,500
This category is distinct from (a) above because of the better prognosis which will be for some recovery with professional help. However, the effects are still likely to cause significant disability for the foreseeable future. While there are awards which support both extremes of this bracket, the majority are between £21,000 and £27,000.
(c) Moderate £5,875 to £16,600
In these cases the injured person will have largely recovered and any continuing effects will not be grossly disabling.
(d) Less Severe £2,800 to £5,875
In these cases a virtually full recovery will have been made within one to two years and only minor symptoms will persist over any longer period.

The bracket for whippy is huge and will depend on the level of pain, suffering and loss of amenity.

Remember though, you don't work out a figure from each bracket and add them together, some discount has to be applied for the overlap in psla.

When your solicitors says substantial, he means tens of thousands.
Don't forget that if you received any benefits whatsoever since the incident you will have the same amount deducted from the award before you receive it. I had £20,000 deducted.
only benefits which you've received which are related to an element of the claim (eg if you received income support that will be deducted from the loss of earnings). i'm sure you asked on here before about the amount of compensation. as you're still awaiting further medical evidence i'd wait for your solicitor to give you a value - but they should really be able to give you an idea of the value at this stage. did you not ask before about getting an interim payment? i seem to recall answering something before about a similar injury claim x

thanks for the information everybody. Nini74 - I have not recieved any benefits so I am ok on that scale, all my solicitor would say to me is that it would be 'substantial', and that is what I was trying to find out, how much is substantial to a solicitor? I am in the process of getting an interim payment at the minute also, thanks.
