To keep it short:
£2 all day parking ticket.
£60 fine.
Purchased ticket with cash and placed upside down (so not readable).
Ticket appealed against.
Appeal rejected with photographic evidence. :(
Ready to appeal to POPLA.

Can anyone quote me some legislation or state some ideas to sway POPLA in my direction? I've read they can only really claim for lost income, so the £2?

£60 is a lot when you're saving for a wedding and we did have a ticket.

We are going to appeal, as if nothing else, it delays Premier Parking Solutions from getting the cash. Hehehe.

The fiance has been told off for the ticket incident!

Any help GREATLY appreciated!

If you get an unfair ticket in a private car park, don't automatically pay it. These supposed 'fines' handed out are merely invoices, often unenforceable, and it's a Wild West out there - many private parking firms are frankly cowboys. This is what it says on this website -

I got a parking ticket in Aldi Car Park - last November and ignored it and the follow up threat. Heard nothing more.
grasscarp is correct, the only car park fines you MUST pay are from the police and your local council, any private parking fine should be ignored, they cannot enforce them.
Hang on they didn't even lose £2, so they didn't lose any income.

Keep a copy of any correspondence (if not too late) in case they should try to go to court.

They won't though, it's not worth their while.

I've copy an e-mail folder with all communications saved in.

I also have the parking ticket and the fine.

It may not be worth £60 to them, but it will be worth it if they add further admin fees and I have to pay any legal fees.

I need to feel sure I can actually win this.

Did the parking company give you a POPLA code when they rejected the appeal ? They should have done.
Use the code to appeal to POPLA. POPLA will come up with an alternate amount to pay based on the actual loss to the parking company, it is not likely to be more than a £ or two.
By 'upside down' do you mean face down so just the back was showing? it would be readable if just upside down ( the top at the bottom but face up.)

Now let us get this right. You pad £2 for an all day parking ticket but put it in the car face down so it could not be read. So anyone looking at the ticket could not read it. It could have been an old ticket left in the car from a previous day so you are saying you should not be fined for parking without a ticket. Get real pal you were not displaying a genuine parking ticket clearly showing the date & time of parking therefore you are guilty of illegal parking & should be prepared to pay the fine. If the parking company take you to court you could be fined by three times the amount you owe.
But Ron, a genuine mistake was made.

You talk as if Squidge and fiance were trying to avoid paying.

When my wife put a ticket in the window it blew onto the floor.
She received a ticket, but after a copy of the ticket was sent the concil agreed to waive the penalty.

This private company aren't so reasonable.
Are we talking about upside down or face down? Upside down is perfectly readable, ask any teacher!

Hoppy I don't doubt that a genuine mistake was made but the undeniable fact is that whatever the circumstances a bona fide parking ticket was not being displayed that day.

One other point whiskeryron - a private car parking company do not have the power to fine anyone; only the police or a court can do that.
yes these tickets are just invoices for parking charges NOT fines!
