What is the law for cyclists undertaking stationary traffic? I was recently involved in an accident wher I was stationary in traffic waiting a few cars behind a zebra crossing. My passanger decided to get out of the car and suddenly a cyclist drove into the passanger door? He was undertaking so the police said cyclist was to blame but now I am being sued. Are cyclists allowed to undertake?

This is what the Highway Code says in section 139.


only overtake on the left if the vehicle in front is signalling to turn right, and there is room to do so


Was there a cycle lane on the road?

the highway code is for all cars, bikes, cycles, and padestrians a like and it is law,, this mans lawer should know this and tell him that he does not have a leg to stand on,, cyclist think they r exepmt from the highway code which is incorrect...

Highway Code isn't bl**dy law and bl**dy idiot passenger should have looked before opening the bl**dy door. Poor bl**dy cyclist should sue for every bl**dy penny he/she can get. The roads would be safer without bl**dy stupid motorists and their bl**dy brain dead passengers.
Most of your average PC Plods are only giving a personal opinion and haven't a bl**dy clue about the Laws of the Land.

cyclist crossing red lights is against the law but they still do it...

there was no cycle path. My passanger did not expect anything to be in between the car and the curb - there was only about a foot of space. The cyclist said he was traveling about 25 mph and tried to swerve but clipped the door and the pavement.
danzf...........Sorry to appear pedantic but the Highway Code is NOT law. It is a publication which quotes various laws which you can be charged with violating but there is no such offence as "Breaking the Highway Code".

Whether or not Undertaking was defined as 'Breaking the Law' - The cyclist Suing you is Civil law rather than Criminal Law anyhow. So what would have to be proved is a 'wrong' - law of Tort.


Indeed,you and the passenger owed a duty of care towards the cyclist and therefore he can and probably will clami damages. Also Criminal actions could be brought by the CPS, dependent on evidence provided by the Police

The policeman at the time told me I could sue the cyclidt for damage to my car and he could face a fixed penanlty fine for undertaking. Do you mean criminal actions could be taken against me?

Actually while studing for driving test we need to understand all highway code properlly.

cyclist crossing red lights is against the law but they still do it and this will cause an accidents. They cross over red signal.
Even road are not much enough wie so this is the one reseon to cause accedents.

Firstly I call ******** on your claim that the cyclist was trying to get through a one foot gap at 25mph. Most handlebars are over a foot wife as is the distance between pedals.

A cyclist is allowed to undertake and the onus is on the car driver to take utmost care. Your brainless passenger should have checked her mirror.

I hope they take you to the cleaners.
4wks ago, i was undertaking a line of traffic which was stationary at red lights. big wide gap between all the cars and the pavement as there is every morning on my route to work. i was about 6 car lengths away from the red lights which were seconds away from going green when a passenger door was opened. i had no time to react and rode straight into it. i was taken to hospital by ambulance with a broken wrist and whiplash. my injury lawyer is in the process of claiming damages for me and 4wks worth of lost wages.
i wasnt taking any risk as my position in the road was where a cyclist should ride. car drivers are responsible for their passengers actions and should have checked it was safe for her to get out.
It seems very difficult to find out whether it is against the law to undertake on a cycle. There is a section under Lane Splitting on www.bikeforall.net but this doesn't help much either. I am a cyclist, motorcyclist and car driver. As far as I'm concerned they are all vehicles and the law on this should apply the same. I would no sooner undertake between the kerb and a slow moving or stationary car on my cycle as I would my motorcycle as I would not feel it safe to do so. It's about time cyclists took responsibility for their own safety instead of trying to blame others for their stupidity.
