i have had a county court judgement against me but didnt receive the notification that i lost the case,today the bayliffs have called and left a ltter saying that they will come back to take goods, the ccj is against me through my company and the question is this can they come into my home and take my belongings or is it just against the compnay?? i am a sole trader by the way
A 'sole trader' is not a limited company so although you refer to it as 'my company', I assume you are just using a trading name. If so, your assets and the company assets are all part of the same entity.
thought that maybe the case,can i go to the courts and ask them to let me pay it off in stage payments alotho i didnt get the judgement thro the post and this is the first i have heard of the outcome? thaks for your answer anyway
Unless its for a civil debt (council tax,rates,tax,parking ticket etc) bayliffs cannot force entry to your property.Period
The best bet is to phone them and ask for an installement plan.
I am not sure but I think you can get the judgement set aside on the basis that you did not receive the court papers (wink wink) but the debt wont go away.It will give you some breathing space.
