Wills/Probate Litigation
2 Answers
My 90 year old mother passed away August last year. She had made me sole beneficiary in her Will and Probate was granted in October. My brother is now contesting the Will and Probate on the grounds testamentary none capacity and undue influence. Both totally untrue. Last few months of my mother's life were made a misery by my brother's harrassment of her with regard to her Will. He also incited other family members to do the same. She knew what was going on and was very upset and angry. When mother defended herself against brother's/relations' badgering and what she saw as 'interference in her life', my brother harrassed her even more insisting she should apologise to these people for putting the phone down on them!!! He was bullying her into apologising for defending herself!! Mother turned against him because of his behaviour towards her and me. He was the one using "undue influence" with regard to mother's Will. This turned her against him and she left him out of the Will. I am now find myself in a position where the finger of suspicion is being pointed, wrongly and unjustifiably, at me and I'm incurring considerable legal costs to defend my name and that of my late mother. Any comments, advice or reassurance on legal outcome would be greatly appreciated? inaquandary

They really arent worth your worry. As long as you know what is true thats all that matters. If its them that are contesting the will then what are your legal fees for? People that know you (like your true friends) will know whether you are a genuine person or not. Why should you 'defend' anything? It's not your problem. Just leave the contesters to fight it out between them. I can't see any reason that they could win. Not going by anything you've written in your two posts.
