Want to update my existing Document, before the Oct 1 deadline, which currently only names my husband. Can I appoint a second individual in the "jointly and severally" section but specify that the second names person will only act if the first named individual dies or loses mental capacity?
For anybody interested in the answer to this question, I've just discovered the answer. The best way of dealing with it is to set up a second separate Power of Attorney which has a condition in it that the Attorney will only be able to act if the named person in the other Power of Attorney has died or lost their mental capacity. So you operate with the first Power of Attorney and the second one only becomes into play if or when those conditions become fulfilled.
