Deposit for a Function Room
5 Answers
Can anyone tell me what my rights are? About 1 month ago, I booked my sons Christening party in the function room of a local pub and left 100 deposit. I went to the pub yesterday to pay the full amount and confirm numbers for the buffet and the landlord I paid the deposit to has been sacked by the brewery and the new landlady said she will honour the booking date for me but I will have to pay the full amount to her again - i.e. I have lost my deposit. I have a recepit - my husband phoned the brewery and they basically said bad luck - you will just have to pay the new landlady again. Is this right or does the brewery have to honour the deposit money?

i would suspect that the law of contract would play a part here. you need to check who you made the contract with - the landlady or the brewery - if she did so in the course of her employment, then the brewery may be vicariously liable or jointly and severably liable. check your reciept- if it was in her name only then you would require to raise a small claims action against her, if it was in her and the brewery name (which i doubt) you could claim either/or
