9yrs ago I purchased my home and was living with an ex partner, I paid all the deposits and have paid every single mortgage payment since the 1st day. My ex partner only lived in the new home for 6 months .
Last month I tried to Re mortgage the property to gain a better deal only to find my ex partner had been added to the Title deeds. I know that neither of us here aware of this fact and I guarantee my ex partner still doesn't realise that she is on the deeds
I do not know where my ex partner is or what her current conditions are.
I have a new partner and little boy who have lived with my for the past 4 years.
My question is how do I get my ex off the deeds to my home without the worry of losing significant amounts of equity and without breaking the law.

I can understand why with a first house purchase its easy not to spot some things. But at the time were you able to get a single mortgage? Some lenders may have insisted on a joint due to the ratio of the earnings to borrowing.
What i would suggest is that you contact her and ask her if you can remove her from the deeds. Hopefully she will be amicable as if shes on your mortgage it will prevent her borrowing against any house in the future.
If she decides she wants equity then you can prove that a) she hasnt lived there for 9 years (i hope she isnt on the electoral role or bills still) b) she has paid no money towards the mortgage, bills or any of the expense associated with the property.
That way it would be a farce if anyone awarded her a share of an equity made in the last 8,5 years.
You cannot remove her name without her permission.

she is not on any bills or any post coming into the home, at the time the mortgage was doen i was working full time and earning well, she was part time and earning very little.
i have heard even though she has not lived here for 7-9 years she is still entitled to half the equity due to being on the deeds is this correct

you will need to get legal advice if she does start asking for the equity but usually as long as you can prove shes never paid a penny then she wouldnt get anything!
Its not as cut and dried as it seems though so i would suggest you try and contact her, if you cant then speak to a solicitor about how you can get her off the deeds without her signature.
Who knows, she may be one of those sensible people who realises that you cant get anything out if you havnt paid in. Sadly there are some in this world who are blinded by greed, I wish you luck
