How long would it take if someone is going to take a case to a small claims court.?Had trouble a few weeks back and was told it was going to be taken to court but haven't heard a word since. Husband thinks they may have had second thoughts about it. many thanks

3 years for personal injury, 6 years for consumer issues. There is no such thing as a "small claims court" - the county court uses a small claims track for personal injury claims up to �1000 and other claims up to �5000.

I have used the Small Claims Court and I dont think it was a dream.

M Tickle has given you the stature of Limitations thing

IF they have taken out a summons it should reach you in about 14 days
and then you get a time date to reply by
and that is about 14 days

and can they get a judgement against you without you knowing ? Not really so long as you havent moved

and if they do, youmay be able to get it set aside.

The Court hearings if any are fun - most of the time the Judge trying them is actually interested in the events. One of two think they are wasting their valuable time but the greatest majority try to get a fair judgement.

The system works quite well.

Lilacben I fear that you might think M Tickle's rather forthright statements say that you can't bring a small claim in the country court
