15% taken off because of open box

I brought a monitor from House of Fraser.

When I got home I discovered the screen was far too big. So I put it back in the box and took it back to the store.

The computer shop is a concession called "TEC 7"

They were ok with returning the monitor although they said they had to take of 15% off the price because the box was opened.

I feel that was unfair. I wasn't told before I purchased it.

They said that because I had opened the box the next customer could not buy this.

However I it was just a cardboard box. I cannot see why they had to keep 15%

Can I take this further?

I doubt it - they weren't even obliged to give you a refund unless it was faulty, which it wasn't. I would either have counted myself lucky that I had got 85% back or kept the monitor.

The two previous answers are spot on. Legally you have no rights to a refund, either in full or partial. The store obviously has a policy that it will accept unwanted items back, but if opened, as in your case, it applies a charge to cover the fact that in effect the item is considered "used". The customer buying your returned item would suspect something was wrong as the box has clearly been opened, and I guess the shop will actually sell it as a "customer return" at a reduced price. So the answer is no you shouldn't complain, but count yourself lucky you are not stuck with a monitor you don't want.

This is a policy I have noticed here in the US too. They call it a "restocking" fee. While it is legal, I think it stinks.

Why does it stink, EngTeach? If someone can't measure a monitor properly then why should the shop accept it back?

What weren't you notified of?
Would you buy new monitor if the box had clearly been opened and resealed- I know I'd put it downa nd picka different one up- so it would stay on the shelf and may never be sold.
Let us know how you get on though- it's worth pushing a bit.
