divorce and property
recntly separated. I have 1 child resident with me in family home. Husband with new partner. House on market.I am currently paying all bills. As I have to provide new home for child and me does 50/50 split after most of bills paid sound reasonable or would I be entitled to more because of child. No maintenance is being paid and I will have an amount out of equity to cover this(before we split the rest) then ex says he won't go for his 1/2 of my pension. I haven't seen a solicitor yet. Any ideas gratefully received as am confused.

A friend did this, his ex wife was forced to vacate & sell property and split was 60/40 in her favour as 2 kids remained with her. Friend has to pay CSA even though ex-wife works.

Having a child with you means that you entitled to a bigger chunk - I am going through a divorce and that is what my soilicitor told me. At the very least, 60/40 in your favour.
Although you don't have to use a solicitor, I would recommend it unless yours is is a simple and amicable case.

I wish u the best of luck. I have had the same problem, this happened over a year ago and I have been seeing solicitors since my husband left me and my two year old. It is now going to court. I would seek some advice mybe through citizens advice first or mediation if you can bear to be in the same room as him? I couldnt! You need some advice. You deserve alot more. thanks all for your comments. Things are reasonably amicable but that could change tomorrow! He has said that a solicitor told him that 50/50 was ok and wasn't happy when I said that 60/40 seemed the norm!! I will be getting some advice, so watch this space.
