Hi ya guys. I was at work yesturday and to cut a long story short floor was wet after being cleaned no wet sign was up and I fell down th stairs hurting my shoulder quite badly. Went to a local drop in centre today they have looked at it and given me strong painkillers etc.. The nurse thinks its just bad strain. When I fell my arm was literally pulled up and behind me. Its quite badly bruised & I have had to come home today because it hurts so much. I filled out the accident book but didnt seek medical help the same day, really because I didnt want to waste hospital time as it didnt hurt too much when it happened. This is all on CCTV. Where do I stand legally?

As an employer, I have experienced the claim mentality of todays employees, and have had an employee claim for an injury which he admitted was totally his own fault, and yet he was urged by a lawyer to claim. My insurance company paid out because it was cheaper than contesting it in court.
What you need to realise greedyfly, is that every time an employee makes a claim, insurance premiums for that company rise, so the next time your application for a pay rise is turned down, you'll know why.
Whilst your firm has a duty of care towards you, you also have a duty under the health and safety law, to be dilligent in your actions, I.E. look before you leap. Or to put it in a way you might better understand, next time you walk into, or out of an area, look where you are walking, maybe then you would have seen the floor was wet and took more care.

Maybe this isn't what you wanted to hear, but you asked for answers.
