property charge by unsecured loan provider
My bank are placing a property charge on my home for not paying the full monthly payments on my orginal loan agreement, is there a outstanding minimum balance amount where they cannot force the sale ? the reduced payment was agreed by the bank and they have passed it on to a debt agency without any advise that they were doing this !

For more on marking an answer as the "Best Answer", please visit our FAQ.I think what you must mean is that they are putting a second charge against your home - the fact you have a mortgage means they will already have a first charge - to secure the sum of the original mortgage.

As I am sure you know, Governments are putting considerable pressure on lenders to minimise the number of people forced out their homes through not being able to pay their mortgages. It is in everyone's interests (except perhaps the lenders) to keep people in their homes during this difficult time economically - even if it means that the outstanding balance that you owe increases a bit whilst you cannot afford to pay.

I refer to a non secured loan with my bank (not my mortgage) they have advised a solicitor will be contacting me to discuss placing a charge on my property, although they had agreed a payment plan with me and i have stuck to the payment plan without fail ? they are now saying without notifying me that they have passed it over to a debt agency who want me to pay almost the original monthly payment (which obviously i dont have !) i have advised them of my circumstances from the outset of my financial demise ? is this legal ?
