Joint Mortgage Query
1 Answers
I have a joint mortgage at the moment which is part buy, part rent. We have had the mortgage for just over a year and are tied in for 3 years (2 left). However, we have now split up and I have moved out of the property. My ex still lives there. He pays for for all the bills and I currently pay for half the mortgage and half the rent. We have tried to get my name taken off and for him to have the mortgage on his own and although he can afford it, the bank will not agree to this as they think he cant. We cannot currently sell the property as the value would be less and we cannot afford and do not want to get into debt.
I am happy to walk away with nothing from the house as I would rather it all be put behind me. Does anybody know whether an agreement could be drawn up to say I can stop paying my share for the house for now and I will not be entitled to anything when we sell? I just want to move on with my life and would like to be able to move out of my parents and rent somewhere but paying for half a mortgage and rent each month makes this very difficult, especially when I feel like Im getting nothing out of it.
Any ideas anybody?

No agreement you draw up with your ex now can override the contracts you have with the mortgage lender. If your ex stops paying you will be just as liable as him.
As he is getting the benefit of the property he could pay you rent for having sole occupancy.
