It's me again. If an item is sold at auction by Bailiffs and realises more than the debt + charges, is the Bailiff legally obliged to send the nett amount back to us?

Why doc? Are they allowed to make them up?
Was the car repossesed because you hadn't paid for the car or was it just one item seized because you owed money?
i thought you had said the car was owned by the finance company so shouldnt have been removed?

Redcrx, it Was owned by the Finance Company and we had an e mail from them stating that but he wasn't interested, wouldn't read the e mail and took it anyway!!!
Factor30, it was just one item for another debt.
They can't do that.....simple. What does the finance company say???? It's their car after all....

We have spoken to the FC and their stance is, that what we owe on the car is so small that they will probably get paid out by the Bailiff.
