Advice Please

I rent my appartment from a estate agents.In June i had my boiler serviced which the 'owner' organised. He wouldn't leave me a copy of the 'Gas Safe' certificate so i asked the agents for a copy & they said they didn't have anything to do with it this time as the owner organised herself. I told them that i pay 'them' not the owner & they said they would contact her. Since then i've asked 3 times & each time they say they will contact owner. Today i got my new contract to sign with a letter saying that the owner took the service out of their hands & left a message once again for the owner to send me a copy! Should i refuse to sign contract until i get my certificate?

According to this site, your LAndlord has a LEGAL responsibility to give their tenants a copy of the gas safety record within 28 days of it being carried out or before they move in.

Waste of time Count. They said the law says that it is up to the 'Landlord'. I told them i pay the estate agent & have no communication with the landlord or who they are? His replt was, 'It is up to the landlord! My reply, 'Thanks for NOT helping me!!!

Your contract is with the landlord, not the agent (look at your tenancy agreement & you will see who the landlord is). The landlord decides what he/she gets the agent to do, & has a separate contract with the agent covering this. If the agent tells you the landlord is dealing with the gas certificate herself then you have to accept that - but you must be given a means of contacting the landlord about it (certainly address, & phone number unless there are very good reasons for not giving you one).

I don't understand what you say you've been told by Gas Safe. Did you quote to them what their website says & ask them specifically whether a copy of the certificate has to be provided to you? I believe it does. Ask them this & if they agree ask them what you do if the landlord refuses to provide it. I believe it can result in them taking Court action against the landlord, but am not sure of this.

This may be a bit late for you but I have only seen it. When a gas safety cert is done there are three copies, and one of these should go to the tenant. It is up to the landlord to provide this for you but the agent could, and should, have been more helpful. They are probably not getting a management fee but their customer service leaves a lot to be desired. If there is no valid safety certificate the landlord could be sent to prison. When you get to see the certificate, even though it may have passed, check to see if there are any recommendations on there as this may be why the landlord doesnt want you to see it as he/she may not want to pay out for the recommendations. Anything from 'install a carbon monoxide alarm' to 'Even though the boiler is safe (at the moment), a new boiler is recommended'.!
