What is the legal position if one ex-partner wants to take the child abroad to live?
4 Answers
When a couple divorce and the mother has custody of the child, does she need the consent of the father to take that child abroad to live abroad? In this case, the father pays maintenance, but has not seen his child for a year because of issues with his ex-wife.

If they were marries then he has parental responsibili ty which does put him in a stronger position.

As far as I can remember it from other answers I have seen on AB,the Mother needs the Father's permission for even a holiday. So taking the child to live abroad could be even more difficult.
Of course it all depends on what the legal custody arrangements are.
There ARE people on AB that have far more knowledge of such matters than me,but I just thought I would put a "stop gap" answer in until the morning when you may get more correct responses.

Thank you all for your prompt response. I visited the site you recommended chelle. Thanks for that - it was very helpful. From what I know of the situation between these two people, it looks like the ex-wife will be able to take the child, because the father is doing very little to take up his access rights. G
