Can the police keep my arrest on file?
Just over 5 years ago i got really drunk and done something drunkenly stupid and was arrested for it, i was charged with criminal damage an given an £80 fine which i paid straight away, i was not charged for the the main thing that i was arrested for as the police knew i was so drunk that i couldnt even hardly walk or talk never mind do the crime, and i never knew why i had been arrested the next morning when waking up in the police cell, i had to ask the policeman why i had ben arrested. (the charge was burgalry as i had somehow mistaken my ex girlfriends neighbours (a few doors up) house with her house and gone in there an got my head down on the couch, no breaking an entry or nothing and everyone puzzled as to how i got in, including me) anyway since being pulled by the police twice in the last year, once on my bike an once on in my car. when they do a name check on me, the mood turns nasty as burgalry is showing up on my name along with criminal damage which i accept, but am i entitled to get the burgalry charge or whatever it is scrubbed completely as i wasnt charged for it and dont wish to be treated like a smack head by the police when i am in fact a hard working citizen who messed up one night through too much drink! cheers for any advice

If you go to the station or write to the force explain that you wish to seek clarificatio n on the recording of this burglary arrest because of your concern's as stated in your opening post.

Many thanks Ex i shall take your advice and when im off work next week i will be paying my local station a visit to see whats what on my record, will they know what i mean if i copy your info about the recorded burg and detected crim damage and put it to them? mrs Chappie, no that aint me lol just some funny lookin creature that tickled me when i first seen it so had to use it as my avatat lol. Ex much appreciated for your time in helping me out and if you can give anymore advice regarding your last piece of advice then feel free to break it down a bit for me so im well equipped (no pun inteneded) with info when i go the station. lol Cheers Kev

If you go to the station or write to the force explain that you wish to seek clarification on the recording of this burglary arrest because of your concern's as stated in your opening post.
Just to summarise first: (obviously I cant say to much on here).
Because of your concern's, you want to know can they confirm whether an offence of burglary was recorded on their 'local system' for the incident you were arrested for or did they ONLY record an offence of 'criminal damage' after it was established that the offence of burglary was not complete.
Ok, If they initially recorded an offence of burglary can they confirm what status is NOW shown on their recordsfor that crime, i.e. has it been marked 'No-Crime' and disposed of or does it show some other 'status' i.e. Undetected or Detected.
On the info you have disclosed it should NOT be shown as detected.
You also want to ask what information would be relayed to a patrol officer about the BURGLARY if a name-check' was requested and conducted on you.
You may not get the info you seek so ask them to identify the person / dept that you need to contact and method of contact.

I have a very small screen Kev (laptop) and avatars look tiny and not very sharp. Glad it's not you though, to be honest, as from what I can see, the chap does look a bit.....errr..... strange. And wearing a pair of earrings too? I'm an old-fashioned lass and only like to see earrings on ladies.
Still, each to their own I say. Live and let live and all that. Looks can be deceiving and we shouldn't judge by looks alone. I used to live next door to a lad who had a bull-ring through his nose. It looked horrible but he was actually a very nice lad.

and the moral of this story is..dont get so shi*faced that you dont even know where you are supposed to be...you are responsible for your own actions..you say you were not charged with breaking and entering but were charged with criminal damage..make your mind up...so how did you get in and ''get your head down'' i wish i had found you trying to get ''your head down'' on my sofa after gaining access to my house..you would have had a baseball bat wrapped around youir forehead..you are not being treated like a smackhead..you are being treated for the person you are...a burglar...

lol housemouse...mrs c yes i have been drunk and i have done some daft things,but i have never broken into someones house to ''get my head down''..can you imagine how they felt to find a complete stranger had ''gained access'' to their house and was asleep on their sofa..ill ask you one question..would YOU have liked it???..
