My partner has had a continuous problem with a gang of lads/men who are hanging around our estate and beating up people, causing trouble and just being blatant idiots.

They have repeatedly knocked our door, causing trouble and my partner has been beat up by these people a number of times.

One night last july they knocked our door and were shouting abuse for my partner to go and and fight with them. He refused and phoned the police. The police came and moved the gang on. Even though they were drunk, causing trouble, shouting and telling the police they wanted a fight with my partner. No arrests were made. Then the ring leader of the gang came back and kicked the bottom panel of our door through. This waking up my 5 year old daughter, she was so scared she wet herself and was sobbing uncontrollably. I was 5 months pregnant and started getting pains in my stomach. Having lost two babies previously i was distressed so my partner phoned the out of hours doctors and was told to take me to hospital. He had a few cans of beer so was over the limit to drive so ran to a neighbours to ask them to drive me down there.
At this point, when my partner was talking to our neighbour the gang had come back with weapons, snooker cues, poles, golf clubs and other things. They ran at my partner and he was repeatedly hit with the weapons. One person fell over him on the floor and dropped his weapon so my partner grabbed it and lashed out to try and get them off him.

This weapon just happened to be a sword and nearly chopped one of the gangs arm off. He was arrested with GBH with intent and charged. He is due in court in a couple of weeks and i am scared to death he will be sentenced to a long term in prison.

He has been on electronic tag, Has a order for him not to be within a 1 mile radius of the gangs homes and has not been able to live with me for 9 months. He even had to go to court and ask for permission to be at the birth of our child.

We know this was self defence, but obviously the prosecution want a result. Two of the gang have made statements to say that my partner was passed the sword by my neighbour but this is untrue.

What would we expect for him to get if he were found guilty of this crime?
I am at my wits end. Am on anti depressants and can think of nothing else but this pending court case.

Many thanks in advance.

Whats that supposed to mean?

See pages 3 to 6. For sentences of less than 4 years an offender is normally released from prison (on licence) at the half-way point in the sentence. For longer sentences a prisoner can apply to be released at the half-way point but, if the application is refused, might have to serve up to two thirds of the nominal sentence.

Thanks chris. He has pleaded not guilty, will the sentencing be worse because of this?

Princessstacie22:
The sentences shown in my link refer to a first-time offender who has been convicted after a trial. Previous convictions (especially for violence) can see sentencing pushed higher. Someone who pleads guilty at the earliest opportunity can see their sentence cut by one third.

So your partner's 'not guilty' plea will put him at risk of a higher sentence than someone who pleads guilty, but not higher than those shown in my link (which assume a 'not guilty' plea anyway)
