I was convicted of petty theft in 1990 of cash 51. I was given a 2yr conditional discharge. I have no other arrests or offences since. I understand my conviction is now spent , however it still shows on police reports i have requested for a US visa. I have been told under the Power of Courts act 1973 or Nacro act 1974 that there may be a ruling that would consider this conviction never have been sentenced up on me?

Hi Mr0307,

Discharges are the subject of much debate and each police force will have different ways of storing and using the information.

A 17 year old offence should not prevent a visa, however I have no knowledge of the stated acts.

I'm sure one of the legal eagles will put us both right.
