courts witness statements with drawn
if 2 people make statements (,in the criminal court ) and one person withdraws there statement .......is it the defendants rights to be informed of this , before he enters a plea of guity or not guilty thanks from uk

For more on marking an answer as the "Best Answer", please visit our FAQ.the police can still use the statement for evidence but it can be dismissed by the judge although very unlikely. depends on previous convictions the judge will know and may let it stand or dismiss the statement. just because they withdraw there statement there is a possibility it will get used. what is it for and i will be able to tell you more? is it the magistrates court or crown court????
You re entitled to know whether a witness has made a retraction statement or is no longer supporting the prosecution. You should be made aware of this before entering a plea but the fact that you were not aware will not entitle you to withdraw your plea as of right. The witness may not have withdrawn the statement even though they say they have. It may be that the prosecutor was not aware of the witnesses positionat the time you entered your plea.
