during on a volutary interview without a legal advisor.I admitted to using a work mobile which did not belong to me ( had my colleagues permission which he later denied ) i used it for my own use regarding a personal matter in my life. 14 months later,The phone could not be found records show it was last in my possesion ( as the number i called was last one traced !! ), I was suspected of theft , however, police could not prove a theft had been committed so therefore because i admitted using the phone i was cautioned ( never arrested ) for the offence of theft by appropriation and dismissed from my job.(feb 07) however in january 08, the said mobile was posted through my door with a note saying it had been found in a bag belonging to persons unamed. The phone was handed back to the police who interviewed me, this was on the 21st jan 08, to date i have heard nothing. Is it possible the caution I received can be quashed now the phone has appeared ??

this sounds like a terrible situation! Whoever had it clearly did not have the balls to come forward and has allowed you to take punishment for something you didn't do. Unfortunately to accept a caution, you accept your guilt in the matter, so it can't be rescinded
A caution stays on your record indefinately, so in that respect it can be even worse than a short prison sentence. Never EVER accept a caution for ANYTHING without taking legal advice.
