The sentencing is entirely a matter for the court.
Wonderful answer voltr4m. Thanks for sharing.
If I'm understanding you correctly, he has done this before then? or are the two convictions, the domestic violence course and the probation relate to this specific occurrence?
Obviously no-one can know the exact details of what went on in this fight, except the people involved.

It maybe that your son, at the extreme is a bit of a thug, or that he has an anger management problem, or maybe he has had enough of his girlfriends behaviour. However he is going to be in trouble big time if he doesn't get some help.
You must be very worried and I wish you the best of luck.
Get him on the jeremy kyle show i am sure he can help!!!
Hi i was convicted once for common assault and had to do a domestic violence course on probation. I was then convicted of domestic violence again (common assault) about a year after the course, i pushed my ex into a wall i recieved 16 weeks custody and i pleaded guilty at first instance. The magistrate said because i had done a dv course custody was only option they went against my good pre sentence report from probation and told me there clamping dowwn on domestic violence hope this helps!
Take a look at http://www.thelawpages.com and search the sentences database for ABH to see what sentences others have received. There are aggravating features such as the previous violent offence and the fact he has been on a course before, so find a good solicitor who can mitigate on his behalf. I might be a good idea if he goes on, or at least registers for, a course like 'Think First' anger management before he goes up for sentence.
Sounds a charmer. He obviously has a problem.
