my son is going to court next week on a racial abuse charge,as somebody claims he heard him say a racist remark. he is not guilty of this,but a solicitor says the worst case scenario is 6 months prison, please does any body know if this has happend before. it seems a bit harsh as he has no previous.
having just been charged with similar - and all chrges withdrawn - the key is what is in your sons statement - you must obtain a copy an d rea dit. it sounds to me that he must ahve admitted saying something for there to be sufficient weight to charge.
if convicted he wont go to prison - he wil lget a fine.
I think you're worrying too much. In my opinion it is EXTREMELY unlikely to get anywhere near 6 months. People who threaten people for years and years get that. The courts will probably try to pin a S39 Criminal Justice Act 1988 (Common Assult) and then aggravate this offence with S29 Crime and Disorder Act. However given the circumstances I would be extremely suprised if he got a custodial sentence. Actually I'd be suprised if he even got Community Service. All will be ok :)
