i was convicted and fined for criminal damage in the summer of 2004 and was wondering if this is classed as a spent conviction under the rehabilitation of offenders act
The 'rehabilitation period' for a fine in such a case is 5 years. (Rehabilitation of Offenders Act 1974 s1 and Table A ). In the case of someone under 18 the rehabilitation period is subject to reduction by half.
i would like to point out that although it might be spent,it does not mean its removed from your criminal record it will stay on your record for life and will always show up on a enhaunced CRB check.
