police are trying to charge me with drink driving but they never followed me and did not catch me in the vehicle on a road the vehicle had been parked on private land for 2 1/2 hours when they tested me how do i stand
It might be easier to answer your question if you told us all of the evidence that the police (allegedly) have against you. The police don't randomly knock on doors and breathalyse people. They must have additional evidence, such as a witness who saw you drinking in a pub and then driving off the car park, or the evidence of witnesses who reported you driving erratically.
1. Were were you initially breathalysed? If so, where? i.e. At home? In the street? At a Police Station?
2. What did the Police tell about why they intended to breathalyse you?
3. "police are trying to charge me". Are you saying that you have NOT yet been charged? If so, was blood taken instead of breathalyser? Are you on Bail?
You state that they had not followed you, yet then state that the car had been parked for 2.5 hours?
From my experience with insurance claims, I would suggest that your vehicle was involved in an accident, it was driven somewhere other than your home address/where it is registered to, but the police found you near it and found you to be over the limit?
Would this be correct? If so, let's hope you get the book thrown at you for all relevant offences
