will i get jail ?????

On octber 2006 i was selling concert tickets on ebay for a gig which was taking place on july 2007 but i sold these tickets 23 in total and to the sum of �3500 with p+p then i got bad feedback on ebay cause of my computer crashing and i was blocked off ebay and couldnt get into my account , then in 2007 i was arrested for suspion of fraud and at the interview i asked the police for their help in tracking down the buyers but i had no reply off them until last week where they have charged me with nine counts of theft stealing money.
i am so scared because i dont want to go to jail as all that i ever wanted to do is pay these people back their money but having no means of contact to them it was impossible for me but all the people had my details but not one got in touch by post and then i would have explained the situation......
i have to go to magistrates court next week and im so worried that i will go to prison for this because i have only ever been charged with twoc back in 1991 when i was 17 and took my moms car and im now 36.. i will be giving the court �300 and will be able to offer �50 a week if they fine me !!!!!!!!!!
can any1 help ???????????

So the tickets were fake,or did'nt the customers recieve them?

the tickets were real but i have no proof of tickets as i work in the music industry and can get tickets off production not the box offices,, im so worried
Birchy i might be a little stupid here,or your being a little vague,so you stole the tickets from work? So is'nt that theft and not fraud,or am i missing the point here?

no the tickets were real and we can get tickets to any kind to any concert as i do all kinds of work eg. v fest , download, glastonbury and all the other concerts as well .but i couldnt get the tickets at the last minite and i wanted to repay the money sent to me but i had no way of contact to do this , i just hope that the courts will let me repay them as i would never steal money off no one ..
Your story does not hold water.

If your computer "crashed" then there are other computers you could have used.

People paid you money and you did nothing to either refund them or send them the tickets.

Now, years later, you say you had no intention of not refunding them. It does not ring true
Oh i get you now,so the folk did'nt actually recieve the tickets but yet payed you first? Wow,how stupid are they,there must be guys making millions fraudulently if thats the way it works! Im assuming that your going not guilty,well if you get found guilty you may or may not get some time,as the crimes not a violent one and the jails are full.If the case only stays in magistrate the max they could give you is 12 months (well that used to be the general rule) But as i think your fighting it its probably going to end up in crown,where they could give you anything,if you are guilty then it might be worth thinking of entering a guilty plea in the hope that they keep it in magistrates court and are lenient on you,but if you really did'nt mean to scam them then you'll have to fight it all the way as anyone would! What has your soliciter said about the case and do you have proof that you tried to pay everyone back out of the kindness of your heart and not because you realised the game was up?

i begged the police back in 2007 for their help in tracking down these people and they said they would but 2 years later still nothink just being re arrested for theft of money..
its being held at magistrates court and ive been told to plead guilty to the charges (i dont want to) but i just hope it goes in my favour to plead guilty and not just signing me a jail card>>>
Yeah but why plead guilty if you never done it intentionaly?
Well i reckon you'll get community service and a fine,but id take some money,a radio and tobacco with you to the court on sentencing day just in case!

Aah,thanks for the explanantion knobby,so if this the way things work with the tickets,then surely this happens all the time,and if this is the case his solicitor will have a leg to stand on?
Anybody who sells something they don't have is just asking for trouble.

If I was a buyer I would be telling the "seller" that I would not be paying for the tickets until the seller had those tickets in their hands.

i tryed to but ebay restricted my account and wouldnt help me
Of course Ebay put a stop to your account.

People complained they had paid you money and got nothing. What else would you expect Ebay to do?

How did these buyers pay you?

And who told you to plead guilty - your solicitor, or somebody else?

by cheque and bank transfer and yes my brief told me to plead guilty to theft
wasn't SCUM a great film !
I think your solicitor is giving you good advice, based on what you have said here.
