ABH and Battery Charge (against Child of 4)
Hi, my husband was arrested last week and has been charged with ABH against our 4 year old son and battery of me (for coming to rescue the child) The attack has left very visable external injuries to my son and obvious mental effects too. It was a repeated attack over 15 minutes, with him attacking him three seperate times during the whole incident, five minutes apart.
He was arrested earlier in the year for assult on me, but he scared me into dropping the charges due to threats to kill myself and my family and take the children abroad to his own country. Stupid I know, but now I have told my told and the police obviously and have various court orders in place, so I am determined this time not to allow any further harm.
I don\\\'t suppose he would be facing custodial? Obviously I\\\'m hoping and praying for that but don\\\'t want to get my hopes up. What you do think?

Hi Leesha: There are a lot of factors for the courts to consider to imprison some one, (he obviously has to be found guilty first). however, with the offences you describe I would hope a custodial sentence would be the starting point for the courts and then hopefully deport the maggot.
I would also hope the police have assisted or advised you in getting injunctions against your husband. If not have a look at ncdv.org.uk (National Centre for Domestic Violence) who can provide a free service.

If you are concerned about the possibility of your estranged husband attempting to abduct your son and take him to another country I would suggest that you talk to re-unite. They will best advise you and they have close links with the ICACU International Child Abduction and Contact Unit. The family court in the UK does have the power to confiscate his passport. You should obtain a residence (custody) or preventative court order to stop your child being taken out of the country. Its worth a chat with them anyway. because they will send you some advise notes also. They are very good. You can write to the identity and passport service enclosing a copy of the order asking them not to grant your child a passport if an application is made for one by your estranged husband. If your estranged husband is not british he may be able to get a passport through his own embassy, high commission or consulate. Your solicitor can write to these to request that they not issue a passport. Kind regards
