ABH charge bottled
2 Answers
Hi Im new here but would appreciate some advice, I got held down and punched by a girl whilst the other one hit me around the head with a bottle outside a night club she hit me about 6 times they where part of a group of 6 girls and i had 2 friends with me. The police arrested and charged the girls the one with the bottle was charged with GBH and the other assult the girl who bottled me pleaded not guilty the other guilty.
They later had a joint charge of GBH and were at court last week the defence ajorned it untill this week and they are yet to enter a plea.
There is CCTV footage of the girl although becaue its in a beer garden an umrella is blocking what she had in her hand although you can see that she is hitting me with something but not what, She has said she was trying to split it up, The hospital report shows I have been hit with an object which has resulted with my head being glued both my friends are witnesses and there accounts line up with the events but they are not classes as idependant witnesses as they are my friends no other witnesses have come forward.
If this goes to trial what is the likely hood of them being found guilty if they plea not guilty? also what is the possible sentances they would recive if they plea not guilty and get charged or if the plea guilty they both have previous conviciotions but not violent ones???

If it's ABH, the table on page 17 of this document applies:
http://www.sentencing...inst-the%20person.pdf
For GBH see page 15. For GBH with intent see page 13.
The sentences there are those which judges are obliged to adhere to unless there are very exceptional circumstances (which a judge must explain in open court). They refer to first-time offenders convicted after a trial. An early guilty plea can see a reduction of one third of a sentence. Previous convictions can push the sentencing range higher. Acting as part of a group will be seen as an aggravating factor, and will push the sentence towards the upper end of the relevant range.
