Is this the same offence as your last questions?
The simple answer is 'Yes'.

'Section 20' GBH (without 'intent') is theoretically an 'either way' offence, which means that it can be dealt with solely by a magistrates' court or passed up to the Crown court. In practice the vast majority of cases are handled by a Crown court. That usually means that there's usually at least a 9 month period between the offence and a trial and/or sentencing. 12 to 15 months is probably more typical.

yes it is, this is crap i've lost out on two carpentry aprenticships because of all this going on thinking it was going to be dealt with quickly

yeh
Question Author
dunno really thinking time inside but then i think il get suspended sentence i know i've wonderfully fluffed up big time but i never went out to cause this atall someone has tried attacking me and i reacted and went over the top
The vast majority of 'Section 20' offenders receive a custodial sentence so any apprenticeship or employment is likely to come to an end when you get sentenced anyway.

The sentencing guidelines are on page 15 of this document:
http://www.sentencing...inst-the%20person.pdf
The sentences shown there refer to a first-time offender convicted after a trial. An early guilty plea can see the sentence reduced (by one third in the case of a custodial sentence) but previous convictions can push the sentencing range higher.

i will never go by those guidlines, i have seen people do worse than me using weapons with intent and walk away even read in a paper of a bloke with 43 previous convictions and then got done for and unprovoked attack and walked out free so if they went by those everyone would be locked up
Just done jury service where both got done for Section 20, one got 15 months and the other got 30 months less the 3 months he was detained for

Both were stabbings, if it wasn`t for 3 lilly livered jurors they both would have been done for Section 18
Question Author
go on that site and add up how long you would spend in prison for gbh, abh and common assult all in one when you get an answer put on here and il tell you how long someone actually got for that
Question Author
mine was nothing like stabbings, i got started on tried walking away while trying got hit threw a punch back and chucked this man to the floor somehow breaking his leg i didn't rap my leg around his or nothing like that hit him a few times and the worst part which has made this so bad put in a kick and i do hold my hands up and say i was completly out of order for that
Based upon your account of the events, your solicitor or barrister should be seeking to get the charge reduced to 'ABH'. To see the difference between 'ABH' and 'GBH' read paragraphs 45 to 58 here:

well its the injuries sustained thats made it go up, done something to his eye aswell claimed he was having double vision and blurred aswell even though i seen him driving a car :S his son told me hes going for compensation
Whatever the outcome, I hope you`ve learnt a lesson, next time you get thrown out of a pub and someone hits you, if you are going to hit them back, just hit them once on the chin and walk away
Question Author
learnt my lesson from all of this no point in fighting back just walk away
If someone hits you for no reason, it`s not natural to walk away, run away yes, but walk away no, no doubt they are p!ssed too and if you walk away you are likely to get another punch, one punch to the chin or solar plexus then walk away
Why do you believe anyone would give someone like yourself an apprenticeship?
i take it this bloke isnt being done for punching u??
Question Author
