I think most judges who say 'custodial' mean instant custody, whatever the semantic arguments abouit the meaning of 'custodial'. The judge will always warn a defendant not to get hopes up and that he's thinking of custody. What happens in the end will be influenced by reports the judge will have when sentencing. Your solicitor must be hoping that the sentence will be suspended,come the day, but no more. .
