My mate lives with his girlfriend and two daughters in her house.
The police came banging on the door saying that they were looking for one of the daughters' boyfriends who was a known offender and they must open the door immediately.
After gaining entry (without a warrant) and as they were looking round the house for the offender, they found cannabis growing in a cupboard and my pal told them it was his, then when asked if there was anything else before they search, he told them there were 7 ecstacy tablets in a drawer that he found at Glastonbury festival months ago.
He was arrested and charged with cultivatig cannabis, and possession of class A drug for the tablets.
Thing is, 5 days later, his girlfriend has decided that she can't let him take the charge for her stuff and wants the charges to be dropped and placed onto her. Is this possible or is it too late for him???
If they didn't have a warrant you shouldn't have let them in.
if the girlfriend wants to admit the drugs are hers then they should listen to this, she needs to be very careful and say that they were for her use only, if she mentions at any point that any of what she was growing was for his use she will be up on a worse charge of supplying or intent to supply.
They wouldn't have needed a warrant if they believed the person they were looking for was inside and was wanted.
The girlfriend can say its all hers, but if your mate has already said its his then chances are they will both be charged for the offence and it will be for the court to decide. If your mate has been charged then it is too late to tell the police so she will have to go and tell the court.
