charged with section 39 and its my first offence

Over the weekend i was drunk, and in a moment of madness i retalliated to some abuse and slapped my wife accross the face. This was witnessed by 3 police officers and i was arrested under section 39. However when interviewed i didnt comment on any of the questions in which all three police officers claimed i punched her. this is incorrect but i will plead guilty for slapping her because it was wrong and im not proud at all. i have been charged but im wondering how far this can be taken?

hitting a woman under any circumstances is utterly unforgivable, the courts should be able to put down a mandatory life sentence with no remission or chance of parole.

Does this include if a male is getting punched,kicked scratched etc. How many minutes does the male have to stand and accept the injuries before appropriate restraint can be undertaken so they can at least get out of the house? Serious question.

What does your wife's statement say in relation to the assault. As it happens you are guilty of assault irrespective of how much verbal abuse you were getting. If she says you punched her and corroborates what the police put in their report you may have a job getting the magistartes to reduce the recommended punishment. If however she does feel she pushed/goaded you and is happy that this is a one off and concurs with your side of the story things should go a lot better.

Should have walked away though. I assume that this is a one off! If not, you deserve everything you get for getting drunk when you know what happens from previous experience. Stay in control!!!!
