back to court after just getting a suspended sentance
hi
my boyfriend has just been giving a 51week suspended sentence for 2year this september for a section 47 charge which had been going on for 17month
he is now back up at crown court for a conspiracy to sell class b drug charge, this all started at the end of april this year (so it was actually after he was giving the suspended sentence) how will this effect him when we go back?
i am up for the same charge with him on the same day , what happened is i was the driver of a serious car accident at the end of april, injury's were quite serious with me and passengers, including, broken thema bone, staples in head, smashed pelvis, collapsed lung, broken ribs! baring in mind my boyfriend was NOT a passenger but he ran up to the scene after receiving a phone call off me screaming and he was worried, i wanted him there!, there was an ounce of which i thought was a legal high in my bag at the time! the police are saying it actually had 2 different class b drugs in there too ( i obviously wasn't to no this! ) but they are now charging us both with conspiracy to sell class b drugs as they think we were both in on selling it! i am also up for drink driving and driving without licence or insurance too! i have no previous convictions and my boyfriend doesn't have any other convictions apart from the one i have mentioned,
can some1 please gave me any advice on what will happen ext?
thanks

Perhaps I have completely misunderstood this. My personal view is I cannot see how the BF can be liable. If evidence is given that you were involved in a car accident and called him to the scene I do not see how he can be convicted - given that he was essentially in the position of "rescuer". You seem to be the one likely to be sentenced.
Given that the April incident predates his suspended, I also cannot see how his suspended (bender) can be invoked. The point of a bender is that it is offences after the sentence that are taken into account. I should take legal advice ASAP if I were you.

no he has never spent time inside, he got a suspended sentance but he recived this AFTER the crash incident!
yeah i dont see how they can charge him either but they have, the solicitor has said the conspiracy charge is most likley to get dropped as there was no evidence to say we were selling it ,( as we wernt) the crash happened on the thursday before the bank holiday i had just gettin that stuff before then and was for that weekend for all ov us that wer going out 34 in total! police obviously have all this on tape from the interviews

If you give it away, it's still possession with intent to supply!!!
Rachybaby, I've re-read your posts but I can't work out what order this happened in. Your original post seems to state that the possession with intent following the car accident came AFTER the bender, but a later post seems to imply it was before the bender was handed down. Just point out in very simple words the order of things please. It does make a difference. I know I am being thick today but I am suffering MDI.
