Hi, does anyone know about this company?! I parked in a carpark for an hour too long (this was a genuine mistake as I did not read the signs) and have received a fine for £60 (£40 if paid within 14 days). This is a carpark that I use a lot and have done for the last 6 years for the different shops which are on the site so I am slightly disgruntled!!!! Anyway I have just phoned the automated number and paid the £40 and then googled the company and there are loads of people saying that it is a civil matter and an invoice not a fine and therefore legally it doesn't have to be paid?! Does anyone have any further knowledge/information on this?!!!! Thank you!!! :)

Are you in England or Scotland?

As fas as I'm aware in Scotland they can;t do a thing if the car park is there to rpovide some sort of service for the shops. IE customers coming to spend money.

Not typed well, but it's late at night for me :)

By using the car park you've entered into a legally binding contract to pay the charges which are displayed (including any penalty for over-staying). There are plenty of people who will tell you that you can't be sued but you might be unwise to believe them:

Eddie - its only where the signage is shown to be deficient that the courts won't uphold the ticket. The company we use has very successfully won claims in the small claims court numerous times. As Chris says, it is a contractual payment for using the parking area and is enforceable in Contract Law if certain criteria are met.
<<I did not put a stamp on the letter so they had to pay to get it.>>

If they ever got it. Decline delivery and Royal Mail probably dump it.
So they decline delivery on a letter they don't know who it is from and still take you to court - top suggestion there!
If you dont put a stamp on the letter the person will never get it unless they go to the PO and collect it after paying a hefty admin charge plus postage

Do you think companies like G24 would go and get it? Not a million years

That's true - if they're calling it a fine they probably don't have a leg to stand on. But if its a parkingcharge the courts will uphold them in the right circumstances.
