My friend fell too but ive really hurt myself! A few people have said i should claim!? Should i? I dont know how to and i actually would feel bad!! :0/ i have a pic in chatter bank x

You would need to be able to prove negligence on the part of the club and that you have sustained 'real' injuries and/or loss of monies.

What d'you reckon, honestly, happened and why and what are the ramifications?

Can you prove negligence?

For example, let's assume that you were in a supermarket where another shopper has spilt some liquid onto the floor. That shopper has immediately gone to advise a member of staff but, before the store staff can call a cleaner (or put up a 'wet floor' notice) you slip on the liquid. Under those circumstances you'd definitely not be able to claim against the supermarket (as their staff clearly hadn't been negligent). To claim against the other shopper you'd need to know who they were and to show that they'd been negligent (e.g. by juggling with bottles of wine).

While Barmaid will be able to show exceptions, the general rule is 'no negligence, no claim'.

I wasnt p-ssd i had had a few drinks yes- but got up to dance and slipped on a soakin wet floor!! My friend fell separetely- people should be mopping floors- the place was swimming !!! I had a suspected broken elbow thankfully not broken! In a sling repeat appointment in 10days and physio will be needed! Also my leg is in a mess! And im reall really sore strong painkillers arent helping :0(

Tinkerbell, I was at a wedding show a few years ago, it was raining outside and I went out into the lobby which was tiled. There was water on the tiled floor which I didnt see. I slipped and chipped a bone in my ankle and was in plaster for a few weeks. I was told to sue as there was no "Wet Floor" signs nor was there any attempt to dry the floor. They logged it in their accident book. I tried to sue on the advice of other people.....according to the company I phoned, I had no case as it was their word against mine and they told the company there was a sign there.....I can 100% tell you there wasn't a sign, or I wouldnt have wasted my time.

It may just be my luck...you may well be luckier, however the fact you had been drinking may not look good for you. Also did you report the accident to any of the staff and did they log it in the accident book?

No pink...its my arm aswell which is almost broken- the pyjamma trousers are easy to pull on with one arm- thanks for ur help
