parking fine

one of my drivers pulled over to answer a call in a restricted parking area, they were approached by a policeman and the driver then moved on straight away. We have now received a fine

should the policeman have told him he would be getting a fine at this time? the driver is under the impression he was told to move on and that was the end of it

of course this is the drivers version to me (scary fleet manager) so may of been sanitised

Depends on the restrictions. If it was on a red route or in a no waiting/no loading area; or a designated taxi rank, loading bay, doctors bay, disabled bay then he cannot stop there to answer the phone.

i know he couldn;t stop there, but should the policeman have told him he was issuing a fine?
Really? I got a ticket for briefly parking in a loading bay...and got off on appeal.

Police officer waas probably m,iffed your driver drove off on him, so gave out the fine.......you stand a good chance on appeal as youmention he was told to move on. You usually dont get a fine if asked to move on, so just a verbal caution.

that's what i've told him to do - he spoke to the policeman he didn;t drive off on seeing him, that why i think he should of told him he would be issuing a fine

i'm also confused as the offence was in scunthorpe and the issuing authority is bedfordshire police???
Got a good case i think then, fluff.....if he spoke to the officer he should have told him he was fining him surely.

And Scunthorpe is in Lincolnshire i believe, is'nt it?....how did Bedfordshire police send out the fine?.......how strange.....a case for Mulder and Scully methinks :0)

very confusing - could be error by lease co though, i haven;t seen the fine yet just been notified by them
you can easily try to dispute the fine in a variety of ways...but, yes - the copper will have told him about the fine or...if done in the driver's absence, will have issued paperwork. sounds like you've been told a pile of horse s...! x
On the assumption that parking in the authority where he was stopped is decriminalised then a police officer will not have issued a 'parking fine' (penalty charge notice). A police officer can issue a fixed penalty notice for 'obstruction' or might it have been for using a mobile phone whilst driving? Using a mobile phone, though stopped but with the engine running is still an offence. In either case appeal is only via the magistrates court.
Maybe there were two incidents -one in Scunthorpe (the one the driver knew about) and another one in Bedford.

no it was an error by leasing co, was issued by north lincs council
