Aeroplanes flying over my house before landing at Birmingham Airport?

The aeroplanes fly over my house every 5 minutes all day every day. It is driving me insane. The aeroplanes stop at approx 02.00 then restart again at 06.00.
I don't live near the airport, however I've been told this is the route the plane takes. Tough luck basically. Can I take Birmingham Airport to court as their aeroplane operations are affecting my life and disturbing my peace. My sleep is always disturbed. When I go in the garden all I hear is planes flying over every 5 minutes.

Try this link, at least you can see which aircraft are overhead and which are on the way towards you.

Thank you EDDIE for the flightradar website, just watched a PIA flying past our house on its way to Islamabad from Manchester.
We have planes going over (Kingston Surrey) every minute to Gatwick and Heathrow, but I don't hear them at all. Airports are about 3/4 hour each way by car. Maybe double glazing would help? As mentioned before you may be able to get a grant for this.
agree dave, some people do like an animated view like a motorway or an airport outside their window :)

no of course you cant - any more than you could sue the owner of a bus company for having a route past your house - they are perfectly entitled to fly their aircraft in that area.

what are you expecting them to do? close the airport? do detours? what are you hoping to get out of it?

why dont you get double glazing?
your solicitor should have pointed out it is on a flight path - it is not the airports problem that you were not aware of it sadly. You will have to either put up or move i fear as it is not going to change in a hurry and what exactly would you sue them for!!!

I would like to thank the majority of you who answered the question, especially Eddie 51. I have taken the positives from your answers and disgarded the insults.

I was surprised how some people show lack of compassion and ignorance, because the problem doesn't affect them.
I already have double glazing and I know that people sue companies etc for alot worse, so I was only curious.
hehe... had you askked for advice on how to solve the problem, you would have got more sympathy...but you went straight in for the moneygrabbing throwing your weight around option....
About 10 years ago I used to stay at a friend`s house in Windsor after a good night out. You wouldn`t believe the noise when aircraft were landing into Heathrow at the crack of sparrows. It was like the planes were going through the roof! Your only options you might have are to complain about the situation ( and I don`t think you will get very far) is to complain to your local MP or find a local anti-airport pressure group.

Monetary gain was never the issue. If I was awarded any money, which is not the case. All the money would be given to charities like Cancer Research, Help for Heroes and British Disabled Alliance. Posting a question on this website is asking for other peoples advice. You don't want to be put down or ridiculed, anyone can do that. Joko, if you can't say something nice, don't say anything at all.
it could be a flight traing area for light aircrafts
I remember a situation when a plane carrying cows crashed near a Midlands airport a few years back. The people who do not work all came out of their houses in their night clothes and it was then decided to change the flight path to be over the working people who were less likely to be home if something happened! I am afraid there is probably not a lot you can do except to move. You would have to look into the night flying regulations for the airport and see if they are being infringed. We used to have a 3 am flight on a Wednesday morning at Heathrow which I phoned in about once or twice. Apparently the airport gave the airline a huge fine for flying at that time and they paid it.

Nevertheless, stevie - the others are right. The airport and the flight paths were there presumably before you bought the house. Were you not notified? If there were something new, which was affecting a large group of residents, then there might be group petitions etc - but the fact that you are disturbed (and you don't mention any of your neighbours) suggests that it's you rather than an environmental issue affecting the neighbourhood. If it was there before you moved in, then you don't have a chance, IMO. Others seem to enjoy the traffic from these posts, I've lived near Gatwick and it didn't bother me.

We're not being negative or unsympathic - you asked the question, and most of us are saying that the answer to your question is No.
