If a husband and wife are in process of divorcing, can the wife sell the car which she has used for 3 years, she has the documents but they are all in her husbands name ????

Who actually bought the car and do they have documentation to prove it ?.
Only the owner can sell a car. The registered keeper can't.

Thanks very much for replies. Her husband bought the car, I do not know whether he has documentation to prove this. All of the information is very helpful, thank you both. J.
This has made me think.
I sold my husband's car before probate came through.
I supose technically it was not mine to sell at that point.

No Tony, of course not, we are in agreement here. My point was her husband wouldn't be able to come after her for the money would he? For there to be probate her husband has died. Unless you meant it as a joke?

To be honest unless it is something like a vintage car I would just go ahead and sell it as it could be replaced if necessary.

Make sure the car has not been part of the financial settlement within the divorce, or if it has been it is your friends to sell, remember the V5C document is not proof of ownership but who should tax and register the vehicle.
