i moved into a rental property 3 weeks ago now my friend doesnt want to be my gurantor anymore. can she pull out? my tenancy is assured shorthold tenency and at the bottom of her guarantor form it says ( the provisions of the indemnity shall apply to any increased rental and/or to any continuation extensions or renewal or re granting of the tenancy created by the agreement whether by operation of law or agreement between the landlord and the tenant) that looks to me that i can keep tenancy and even renew it without her backing out. is this correct?

Guarantors cannot back out once they have signed the agreement.
done deal and too late! but unless you default, it won't matter!

great thanks alot for your response!! is that forever so in 6 months when it needs reniewing will i need to find another garuntor or does that bit not need to be resigned? she is clearly not going to resighn it but im not sure if they just carry her over as she already sighned? x
i would prepare for that eventuality now!
Amy can I ask a couple of things please, first what is the name of the agency you are using and second, what is your age?

it says its an assured shorthold tenancy agreement
that doesn't affect this issue! it's when you renew that you will need a new supporter!

ok thats what i thought would be the case but was confused as in the contract it said about continuation, extending or renewal and she had signed it?
she may be 'legally bound', but if she doesn't wish to play along, find someone who won't let you down, ready!

I know my question doesn't affect the tenancy agreement or the guarantor situation, I was just curious as I acted as guarantor for my son on a six month assured short hold tenancy with no mention of this being extended, after eighteen months he faulted on the payments, I was then taken to court for this but the judge awarded in my favour as in the agreement there was no mention of the tenancy being extended, but he did tell the agency that they should reword their tenancy agreements.
