Recouping incorrect Care Home fees

I have read that there is now only a short time to recoup incorrectly charged Care Home fees.
My mother in law was in a care home suffering dementia prior to 1 April 2004 until her death in June 2004. We had to sell her home to pay the deferred fees.
I see there are lots of 'No win no fee' lawyers advertising for this service but I would like to pursue this myself.
Can I do this myself and who do I claim from?
Would appreciate any advise on this subject.

If you want to choose a home for your reli that is more than the council will pay then you do/can top up the council's allowance. People do this to get their reli int a nicer/closer home than the ones that the council will provide. This is different from a need eg severe dementia, where the council/nhs have to cover the cost.

Subscribers mention the NHS but I think it was the Local Authority we were dealing with.
if there was no question of nhs funding for nursing care, then i think you have no chance

This is NOT to do with circs where pressure was put on relis to top up care home fees in circumstances where the patient has or had no primary nursing need (dementia, stroke and so on which mans that the patient cannot be cared for at home or live independently) This is SS trying to get cash out of relis. Relis, as has been said, have no responsibility to contribute to care from their own assets.

This incorrect care home fees thing is about where someone has a primary nursing care need (stroke, dementia and so on) and the NHS should have paid a contribution but did not and therefore the patient's assets were taken to pay for what the NHS should have done. Yes sometimes the SS will have put pressure on relis to fund the NHS bit instead of getting it from the NHS and yes sometimes the relis would have done this and are entitled to get it back but from the NHS.

If you read any of the no win no fee websites, they will explain this. If you want to do it yourself, as I have said, go to the PALS service at your PCT (local NHS organisation) who will help you.
