Unmarried separation
1 Answers
My father has left me some money in his will. Until recently i have been living with my unmarried partner, but have now split. She's after as much as she can from me, and although unmarried she has tried to claim funds buy placing a "restriction of land" on one of my houses, but is she entitled to any of this inheritance? She was never mentioned in the will. Also, what can I do to prevent her claiming on my house? Thanks

What may happen, however, is that one may claim that an asset in the sole name of the other really belongs to them jointly. This could arise in a number of ways. For example A and B could buy a house to live in, agree that it will belong to them jointly, but for some reason it is put into As name alone. B can still claim part of it. Alternatively they may not have actually agreed anything, but B may have acted to their detriment in reliance upon the representation that it was a joint asset, contributing towards the purchase price or whatever.
You can bring a cliam in the Courts to have the restriction removed, and obtain a declaration as to what she does, and does not, own.
